Shortly after, in <strong>October 2023<\/strong>, my monthly maintenance fee abruptly rose to more than <strong>$1,000<\/strong>, with little clear justification beyond insurance costs. Confident. Almost theatrical. Yet the same patterns seen today\u2014retaliation, legal intimidation, and financial opacity\u2014were already visible then.<br>In <strong>2023<\/strong>, unable to sell my home due to new construction defects, I re-entered the fight\u2014this time fully documenting every event.<\/p>\n\n\n\n<p>Since then, evidence has revealed:<\/p>\n\n\n\n<p>Over <strong>$10 million in potential exposure<\/strong> linked to construction irregularities, including missing insulation, unauthorized furring strips, forced window replacements, and possible inflated billing.<\/p>\n\n\n\n<p>More than <strong>$1 million in city fines<\/strong> since 2008, reportedly concealed by former management and legal counsel.<\/p>\n\n\n\n<p>Allegations of <strong>retaliatory foreclosures<\/strong> against vocal owners.<\/p>\n\n\n\n<p>Apparent <strong>police collaboration<\/strong> in several incidents involving owner removals or intimidation.<\/p>\n\n\n\n<p><strong>Regulatory agencies<\/strong> aware of the situation since 2008 but allegedly unresponsive despite at least fifteen formal complaints.<\/p>\n\n\n\n<p><strong>Current leadership<\/strong> accused of suppressing owner rights, blocking repairs, and issuing unfounded accusations.<\/p>\n\n\n\n<p>In 2023, after being unable to sell my home due to new construction defects, I was <strong>drawn back into the fight \u2014 and this time, I&#8217;m documenting everything.<\/strong> <\/p>\n\n\n\n<p>Since then, I\u2019ve worked to uncover: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>$10M+ in potential exposure<\/strong> tied to a <strong>construction project with significant allegations of fraud<\/strong> \u2014 including missing insulation, unauthorized furring strips, forced window replacements, and concerns of inflated contractor billing. <\/li>\n\n\n\n<li><strong>$1M+ in city fines<\/strong> since 2008, allegedly due to <strong>unlicensed contractors, and reportedly concealed by HOA legal teams<\/strong>. <\/li>\n\n\n\n<li><strong>Allegations of retaliatory foreclosures<\/strong> targeting vocal owners or Board critics \u2014 a pattern seemingly consistent with suppression tactics. <\/li>\n\n\n\n<li><strong>Apparent whistleblower retaliation<\/strong> in plain sight: public character attacks, police involvement, and concerns of manufactured threats designed to discredit dissenters. <\/li>\n\n\n\n<li><strong>Alleged police involvement documented in 120+ videos<\/strong> \u2014 raising concerns of officers enabling Board overreach, purported illegal meeting removals, and intimidation. <\/li>\n\n\n\n<li><strong>DBPR and city officials<\/strong> have reportedly been aware of these issues since <strong>2008<\/strong> \u2014 yet concerns remain about their failure to act despite <strong>over 15+ state complaints<\/strong> and <strong>$4.85M in questioned contracts<\/strong>. <\/li>\n\n\n\n<li><strong>Current Board and Counsel<\/strong> appear to have cut off communication, reportedly suppressed owner rights, and allegedly blocked repairs while <strong>making unverified accusations against owners<\/strong>. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Statement on the Engineer\u2019s Window Findings<\/strong><\/h3>\n\n\n\n<p>The Association\u2019s own engineer initially stated on record that the upper-story windows <strong>only required caulking<\/strong> as part of the exterior work. This was the position shared during the early construction briefings and reflected in the visual inspection reports the Association relied upon.<\/p>\n\n\n\n<p>Yet shortly afterward, the engineer\u2019s position abruptly shifted to claim that those same windows now <strong>\u201cmust be replaced\u201d<\/strong>\u2014a complete reversal with no documented change in conditions, no updated assessment, and no new structural findings that would justify such a dramatic escalation in scope.<\/p>\n\n\n\n<p>This contradiction raises serious questions about:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The consistency of the engineering guidance being provided to owners,<\/li>\n\n\n\n<li>Whether technical recommendations were being influenced by non-engineering factors,<\/li>\n\n\n\n<li>And why the Board continued moving toward mandatory window purchases <strong>without the 2\/3 owner vote<\/strong> that they had acknowledged as legally required since at least 2011.<\/li>\n<\/ul>\n\n\n\n<p class=\"is-style-text-annotation is-style-text-annotation--3\">In plain English:<br><strong><em>The engineer said \u201ccaulk them,\u201d and suddenly by 2023-24 the narrative switched to \u201creplace every window.\u201d<br><\/em><\/strong>Owners were never given a clear, evidence-based explanation for that reversal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Statement on Owner Impact and Avoidable Financial Loss<\/strong><\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The Full Picture: What Owners Were Never Told About Siding Options<\/strong><\/h3>\n\n\n\n<p>Across multiple years of minutes, the Board and its advisors openly discussed that <strong>siding replacement required a 2\/3 owner vote<\/strong> because it was a <em>material alteration<\/em> under Florida law. Yet when the 40-Year project was executed, that vote never happened\u2014and owners were never shown the real range of siding choices or the massive cost differences.<\/p>\n\n\n\n<p>Here\u2019s the reality:<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>1. Stucco (the cheapest, most durable option)<\/strong><\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Code-compliant<\/li>\n\n\n\n<li>Termite- and rot-resistant<\/li>\n\n\n\n<li><strong>$7\u2013$10 per sq ft (cheaper than T-111 by $7\u2013$8 per sq ft)<\/strong><\/li>\n\n\n\n<li>Long life, minimal maintenance<\/li>\n\n\n\n<li><em>The Board knew this.<\/em><\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>2.
