1. BOARD AGENDA RAISES QUESTIONS ABOUT ABC SUPPLY LIEN RESOLUTION
On October 26, 2026, HOA Justice Now distributed a Watchdog Update addressing ongoing federal and state litigation, the ABC Supply lawsuit involving Austro Construction, and fifteen months of documented homeowner concerns.
The Omega Villas Condominium Association’s October 27 board meeting agenda included the following item:
“ABC Lien from Austro and release of lien resolution update.”
The inclusion of this item is significant because ABC Supply previously recorded a construction lien against the condominium property involving allegedly unpaid materials supplied for the restoration project.
As of October 28, the outcome of the October 27 discussion has not been independently verified. No confirmed account of the board’s statements, decisions, or actions concerning the lien is available for this update.
The agenda establishes that the matter was scheduled for discussion. It does not establish what was decided or how the lien was resolved.
Those questions require supporting records.
2. ABC SUPPLY LAWSUIT: WHAT THE COURT RECORDS SHOW
On August 14, 2026, American Builders & Contractors Supply Co. filed litigation involving Austro Construction, its president Levente Horvath, and Omega Villas Condominium Association.
Broward County Circuit Court — Case No. CACE-26-013254
According to the complaint, ABC Supply alleged:
- Austro owed approximately $918,478.24 across multiple projects.
- Materials delivered for the Omega Villas project totaled approximately $1,829,059.09.
- Approximately $198,079.37 remained unpaid in connection with Omega Villas.
- ABC served the Association with a Notice to Owner by certified mail under Florida’s construction lien law.
- ABC recorded a construction lien against all four phases of Omega Villas on April 10, 2026.
Court records previously reviewed indicate that ABC dismissed its lien-foreclosure claim against Omega Villas with prejudice on September 21, 2026, and released its lis pendens. The recorded lien’s satisfaction or discharge is a separate matter.
The outstanding financial question is how the approximately $198,079 lien was satisfied or otherwise resolved.
Was the supplier paid by Austro? Did the Association contribute funds? Were payments withheld from the contractor? Was another arrangement negotiated?
The available records do not establish which party, if any, paid the disputed amount or the terms of its resolution.
These are allegations and procedural developments, not judicial findings that Austro or the Association engaged in wrongdoing.
3. MULTIMILLION-DOLLAR RESTORATION REQUIRES TRANSPARENT ACCOUNTING
The Omega Villas restoration involves an approximately $4.85 million Guaranteed Maximum Price construction contract with Austro Construction and a $4.6 million financing arrangement.
Homeowners have been assessed substantial amounts to finance the project.
Against this financial backdrop, supplier-payment disputes raise questions concerning contractor payment controls, lien releases, engineering oversight, and protection of Association funds.
Homeowners deserve documented answers to the following questions:
- When did the Association receive ABC Supply’s Notice to Owner?
- On what dates were homeowners first notified of ABC Supply’s construction lien and subsequent lawsuit, and how were those notifications communicated?
- Were appropriate supplier lien releases obtained before applicable payments to Austro?
- Were any Association funds used to resolve the ABC Supply lien?
- Was any amount withheld from, credited against, or deducted from Austro’s contract payments?
- Does any financial exposure remain for the Association or homeowners?
- How much of the construction loan has been drawn, and how much remains available?
- What documentation supports the Association’s current construction expenditures and outstanding obligations?
These questions concern financial oversight and transparency. They do not presume that an improper payment occurred.
4. CONSTRUCTION DELAYS, ROOF LEAKS, AND REPAIR CONCERNS
The October 26 Watchdog Update documented homeowner reports concerning slowed or interrupted construction, incomplete repairs, roof-related damage, and unresolved maintenance issues.
Throughout 2026, homeowners reported periods of reduced construction activity and work that they believed remained unfinished.
Additional concerns include reported roof leaks, damaged doors, and interior repairs that homeowners stated had not been completed.
Separately, a homeowner in Building 16 filed a lawsuit on August 12, 2026, alleging water intrusion associated with roofing operations undertaken for the Association.
Broward County Circuit Court — Case No. CACE-26-013060
The complaint includes an estimated $76,951.35 in roofing-related damage, separate from an alleged water intrusion incident involving a neighboring condominium unit.
These are claimed repair estimates, not court awards. Liability has not been established.
The complaint does not identify Austro as the roofing contractor. Any connection between Austro’s work and the alleged damage requires independent supporting evidence.
With additional homeowner reports of roof leaks, questions remain concerning inspections, warranty obligations, corrective repairs, insurance coverage, and the status of completed construction.
5. HOMEOWNERS DESERVE ANSWERS SUPPORTED BY RECORDS
Board meeting agendas are important historical documents. They establish what matters were scheduled for consideration and provide a chronology of the Association’s stated priorities.
However, an agenda does not establish that an issue was resolved, that a motion was approved, or that corrective action occurred.
For this reason, HOA Justice Now will continue reviewing available agendas alongside approved meeting minutes, financial statements, construction contracts, court records, and other relevant documentation.
Matters warranting continued examination include:
- Construction schedule: Austro’s contractual completion deadlines and any signed extensions.
- Outstanding work: The status of unfinished construction and homeowner repairs.
- Supplier lien resolution: The financial terms and documentation concerning ABC Supply.
- Construction committee: Its authority, responsibilities, and reporting obligations.
- Project financing: Current loan balances, expenditures, and remaining obligations.
- Financial reporting: The availability of updated Association financial statements.
- Board governance: Meeting minutes, documented decisions, and communications with homeowners.
The objective is straightforward:
Establish what was authorized, what was paid, what work was completed, and what obligations remain.
Homeowners should have access to an understandable, documented accounting of the restoration project and the financial responsibilities associated with it.
The Association, its contractors, and other involved parties should have an opportunity to provide explanations, relevant records, and corrections.
6. ACTIVE LITIGATION AND LIMITS ON PUBLIC COMMENTARY
Several matters involving Omega Villas remain pending before federal and state courts.
As stated in the October 26 Watchdog Update, detailed public commentary concerning disputed litigation issues will remain limited while those proceedings continue.
This publication is intended to organize documented developments, preserve a chronological public record, and identify matters requiring further clarification.
It does not assert that any court has determined fraud, negligence, breach of fiduciary duty, or other wrongdoing concerning the matters discussed.
Transparency, accurate records, and appropriate legal process remain essential to accountability.
